Welcome to FancyApe.com, operated by The Composition Group LLC, doing business as Fancy Ape® ("we," "us," or "our"). By using this website, participating in our projects, or making a purchase or voluntary payment, you agree to these Terms of Service.

1) Use of Our Site

• You must be at least 18 years old to make a purchase or payment.
• Do not attempt to hack, disrupt, misuse, or access restricted areas of our website or services without authorization.
• Artwork, images, written materials, and other content may not be reproduced or used commercially without permission, except where an applicable license expressly allows it.

2) Purchases & Payments

• Payments may be processed through Art Storefronts, Stripe, or their authorized payment partners, depending on the product or service.
• Prices are listed in U.S. dollars (USD) unless otherwise stated.
• Customers must provide accurate billing, shipping, and contact information when required.
• Orders are confirmed when payment is successfully processed and the order is accepted.
• We may cancel and refund orders affected by pricing errors, unavailable inventory, suspected fraud, or other legitimate fulfillment issues.
• Applicable taxes, delivery fees, and other charges will be disclosed during checkout.

3) In-Gallery Purchases

Selected Fancy Ape® artwork may be displayed at participating physical locations. Customers can purchase available artwork using the collection's QR code and online checkout.

• The seller is The Composition Group LLC, unless otherwise expressly identified. The host location is not responsible for processing the transaction or resolving purchase disputes.
• In-gallery artwork is sold in its displayed condition. Customers are encouraged to inspect each piece before purchasing.
• After payment, customers may take the artwork home after presenting their order confirmation to staff if requested.
• In-gallery sales are final except where an item has an undisclosed defect or applicable law provides otherwise.
• Questions about condition or undisclosed defects should be directed to us under Section 6.

4) Shipping & Delivery

• Print-on-demand products are produced and shipped by authorized production partners. Other shipped artwork may be fulfilled directly by us.
• Shipping options, costs, and estimated delivery times depend on the product and destination and will be disclosed when applicable.
• Artwork designated for in-gallery pickup is not automatically eligible for shipping.
• Carrier, customs, and other third-party delays may affect delivery. We will assist with reasonable shipment-related concerns.

5) Returns & Refunds

Print-on-demand artwork and in-gallery purchases are generally final sale, subject to the exceptions described below and applicable law.

• Eligible, non-custom shipped artwork may be returned within seven (7) days of delivery, subject to the conditions on our Shipping & Returns page.
• Returns must be authorized before artwork is shipped back.
• Items must be returned in substantially their original condition unless the return concerns damage, defects, or an incorrect item.
• Refunds, where approved, are issued through the original payment method when possible.
• Nothing in these Terms limits rights or remedies that cannot lawfully be excluded.

6) Damage, Defects & Incorrect Orders

If artwork arrives damaged, defective, or incorrect, or an in-gallery purchase has an undisclosed defect, contact support@fancyape.com as soon as reasonably possible, preferably within 48 hours of delivery or pickup.

Please include your order number, a description of the issue, and photographs of the artwork and packaging when available. We will review the issue and determine an appropriate remedy, which may include repair, replacement, or refund, consistent with applicable law.

The requested 48-hour reporting period helps us investigate shipping damage promptly but does not eliminate any rights you may have under applicable law.

7) Leave a Banana — Voluntary Support

"Leave a Banana" is an optional way for visitors to support Fancy Ape's creative work, free resources, and independent projects.

• Contributions are voluntary. No payment is required to access content or projects identified as free.
• Contributions are payments to The Composition Group LLC, a commercial business, and are not represented as tax-deductible charitable donations.
• Contributions do not purchase artwork, provide ownership rights, or guarantee any particular project outcome or future benefit.
• Payments may be processed securely through Stripe.
• If you made a payment in error, contact support@fancyape.com promptly so we can review your refund request. Nothing in this section limits applicable payment or consumer rights.

8) Projects & Free Resources

Fancy Ape may publish creative projects, research, demonstrations, guides, and interactive experiences for public use.

• Some resources are provided free of charge, and participation in feedback or community discussions is voluntary.
• Projects may be experimental, updated, modified, or discontinued.
• Project-specific instructions, disclosures, and licenses apply where provided.
• Unless expressly stated otherwise, informational and experimental resources are not professional medical, legal, financial, or other regulated advice.

9) Intellectual Property

Fancy Ape® is a registered trademark. The Fancy Ape name, branding, and proprietary content are protected by applicable intellectual property laws.

Purchasing physical artwork transfers ownership of that physical item, not the underlying copyright or reproduction rights, unless expressly stated in writing.

Some publicly shared projects or resources may be distributed under separate licenses, including Creative Commons licenses. Where such licenses are identified, their terms control the permitted use of the specific materials.

10) Third-Party Services

Our website and services may use third-party providers for payments, storefront operations, hosting, fulfillment, and related functions. These providers may have their own terms and privacy policies. Payment information is handled by the applicable payment provider, subject to its policies.

11) Limitation of Liability

• We make reasonable efforts to describe artwork and services accurately. Actual colors, dimensions, and appearance may vary slightly from digital representations.
• To the extent permitted by law, we are not responsible for indirect or consequential losses arising from use of the website or services.
• To the extent permitted by law, our liability relating to a purchased item is limited to the amount paid for that item.
• Nothing in these Terms excludes liability or remedies that cannot lawfully be limited or excluded.

12) Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Subject to applicable law, disputes will be resolved in the appropriate state courts in Brevard County, Florida, or the federal courts for the Middle District of Florida.

13) Changes to These Terms

We may update these Terms periodically. The current version will appear on this page with its revision date. Updates will not retroactively change the terms applicable to previously accepted purchases unless required by law or agreed to by the parties.
